    Warranty Policy for Outdoor Professional Luminaires


    This document sets forth the warranty policy of the Eway (sales) organization (‘Eway’) from which you (‘Purchaser’) purchase your professional luminaires. This policy is applicable only to Eway branded professional luminaires (‘Products’) purchased as from November 2018 within Europe. This warranty policy is subject to the provisions as set forth herein and is subject to the terms and conditions included in this document. This warranty policy only applies if referred to in a sales agreement between Eway and the Purchaser and it will replace the standard warranty clause provided in the Eway general terms and conditions of sale


    A.  Warranty period


    Subject to the provisions as set forth in the warranty terms and conditions and as set forth hereunder, Purchaser receives the warranty for the applicable period, as described in section B.1. and B.2. here under



    B.1. Special conditions outdoor lighting


    • This warranty applies to all outdoor luminaires, except for Tunnel and Underpass lighting. The warranty for these products are outlined in B.2.


    • The warranty period starts on the date of invoice.


    • The warranty period is based on a burning behaviour of max. 4,000 hrs/year.


    • The warranty is only valid for products with maximum ambient temperature +35°C.


    • The warranty is only valid for maximum one switching per day.


    • The warranty period is no longer valid when a Purchaser change the driver settings of the product.


    • Dimming and application of network control systems have no influence on the warranty period.


    • There will not start a new warranty period in case of repair or replacement of the product after approved claim. By default, the customer receives the mentioned ‘standard warranty’. On request, a lifecycle service package can be agreed upon after evaluation of the specific application conditions.


    • The warranty is only applicable when the product is properly handled, installed and maintained according to our instructions written in the mounting instructions of the product, and taking into account the specific tolerances on flux and system power, as mentioned in the product documentation available on the Eway website.


    • A claim is only approved valid when the useful life of the luminaire population is below L80B10 during the warranty period of the luminaire.


    • Purchaser shall not rely upon any other information or documentation



    B.2. Special conditions tunnel and underpass lighting



    Due to the different application profile of tunnels and underpasses, the warranty policy differs. Purchaser will receive 2 or 3 years warranty on tunnel and underpass LED luminaires, and 1 year on conventional tunnel luminaires. The exact warranty per product family can be found on the accompanying Luminaire List. The tunnel and underpass lighting warranty is furthermore subject to the same conditions as stated in section B.1., with one exception: The warranty period has no limitation on yearly burning hours, whereas the warranty on other outdoor luminaires in B.1. is limited to 4,000 burning hours per year.



    C.  Summary of the Warranty Terms and Conditions (non-exhaustive)


    • This warranty is valid only for products sold in Europe (excluding Russia and Turkey). In other regions, other conditions may apply.


    • The Products have been properly installed and operated in accordance with the manufacturer’s instructions.


    • Adequate records of operating history are kept and available for inspection by Eway.


    • A Eway representative will have access to the defective Products. If the Products or other parts become suspect, the representative shall have the right to invite other manufacturers’ representatives to evaluate the lighting systems.


    • The Products have been purchased directly from a Eway (sales) organisation.


    • Proof of purchase for the Products is available for inspection by Eway.


    • Labour costs for (de)-installation of the Products are not covered under this warranty





    Warranty policy - Terms and Conditions


    1.  Limited Warranty


    The warranty as described herein shall only apply to Eway branded lighting products sold by Eway Lighting in the territory of Europe, excluding Russia and Turkey (herein after referred to as ‘Product’). The warranty is only applicable to the party purchasing the products directly from Eway (hereinafter referred to as: ‘Purchaser’). Eway warrants that each Product will be free from defects in material and workmanship. The foregoing warranty shall be valid for the period mentioned in the applicable warranty policy for your Products as referenced to in your sales agreement. If a Product fails to operate in accordance with this warranty Eway will provide free replacement of the failed Product subject to the applicable warranty policy and the limited warranty terms and conditions set forth below.


    2.  Terms and Conditions


    Eway’ warranty flows only to Purchaser. If any Product covered by this warranty is returned by Purchaser in accordance with section 3 and within the applicable warranty period set forth in the warranty policy and upon examination Eway determines to its satisfaction that such Product failed to satisfy this warranty, Eway will, at its option, repair or replace the Product or the defective part thereof, or reimburse Purchaser for the purchase price. For purposes of clarity, ‘repair or replace the Product or the defective part thereof’ does not include any removal or reinstallation activities, costs or expenses, including without limitation, labor costs or expenses


    • If Eway chooses to replace the Product and is not able to do so because it has been discontinued or is not available, Eway may refund the purchaser or replace the product with a comparable product (that can show small deviations in design and product specification).


    • No agent, distributor or dealer is authorized to change, modify or extend the terms of the limited warranty on behalf of Eway, in any matter.


    • This limited warranty only applies when the Product has been properly wired and installed and operated within the electrical values, operating range and environmental conditions provided in the specifications, application guidelines, IEC standards or any other document accompanying the Products. If a Product is found to be defective, or not performing per the product specifications, the Purchaser must notify Eway in writing.


    Eway will facilitate the technical resolution of problems. Third party products sold by Eway are not covered under this warranty, except as indicated in section 5.


    • This warranty does not apply to damage or failure to perform arising as a result of any Acts of God or from any abuse, misuse, abnormal use or use in violation of any applicable standard, code or instructions for use including without limitation those contained in the latest safety, industry and/ or electrical standards for the relevant region(s).


    • This warranty shall be void in the event any repairs or alterations, not duly authorized by Eway in writing, are made to the Product by any person. The manufacturing date of the product has to be clearly readable. Eway reserves the right to make the final decision on the validity of any warrantee claim.


    • If requested by Eway, the non-conforming or defective Products shall become Eway’ property as soon as they have been replaced



    3.  Warranty Claims


    All warranty periods mentioned are subjected to a Eway representative having access to the failed product or system for verification of non-compliance. Guarantee claims have to be reported and returned to the local Eway office within 30 days after discovery, specifying at least the following information (additional info may be required on request):


    • Details of the failed Products; for System warranties also details of other components used.


    • Installation date and invoice date.


    • Detailed problem description, number and % of failures, date of failure.


    • Application, hours burned and switching cycles.


    • Where a warranty claim is justified, Eway will pay for freight expenses. Eway may charge Customer for returned Products that are not found to be defective or non-conforming together with the freight, testing and handling costs associated therewith.



    4.  No implied or other warranties


    • The warranty and remedies contained in the terms of the limited warranty are the only warranties given by Eway with respect the Products and are given in lieu of all other

    warranties, whether express or implied, including without limitation warranties of merchantability or fitness for a particular purpose, which warranties are hereby disclaimed.


    • These terms and conditions state Eway’ entire liability and obligation to Purchaser and Purchaser’s sole and exclusive remedy in connection with defective or non-conforming Products supplied by Eway to Customer, whether or not such damages are based on any warranty not explicitly mentioned in these terms and conditions, tort, contract or any other legal theory, even if Eway has been advised or is aware of such defects



    5.  Limitations and conditions


    • This is a limited warranty and excludes, among other items, installation, providing access to products (scaffolding, lifts, etc.), and special, incidental and consequential damages

    (such as loss of revenue/profits, damage to property or other miscellaneous costs not previously mentioned), and is further defined by the limitations and conditions set forth

    in the respective warranty policy and these terms and conditions.


    • Upon request, Eway’ representatives have to be allowed to access the defective Product, system or application for verification of non-compliance.


    Eway cannot be held liable for electrical supply conditions, including supply spikes, over-voltage/under-voltage and Ripple Current control systems that are beyond the specified

    limits of the products and those defined by relevant supply standards (e.g. EN 50160 norms).


    • With respect to products sold to the Purchaser by Eway. but not bearing the Eway name or sub-brands, Eway makes no warranty of any kind, express or implied, including, without limitation, any warranty of merchantability or fitness for a particular purpose, but will make available to the Purchaser upon request, but only to the extent permitted by law and relevant contracts, the warranties of the manufacturer of the relevant product





    Warranty policy - Policy for Indoor Professional Luminaires


    This document sets out the warranty policy of the Eway (sales) organization (‘Eway’) from which you

    (‘Purchaser’) purchase your professional luminaires. This policy is applicable only to Eway branded professional luminaires (‘Products’) purchased from September 2015 onwards within Europe. This warranty policy is subject to the provisions set out below and is subject to the attached terms and conditions (‘Warranty Terms and Conditions’). This warranty policy only applies if referred to in a sales agreement between Eway and the Purchaser and it will replace the standard warranty clause provided in the Eway general terms and conditions of sale



    A.  Warranty period


    Subject to the provisions as set out in the Warranty Terms and Conditions, Purchaser receives the warranty for the applicable period, as described in table 1.



    B.  Special conditions


    • The warranty period starts on the date of invoice.


    • The warranty period is based on a burning behaviour of max. 4000 hours/year. In case of more than 4000 hours/year, the warranty period will be adjusted pro-rata.


    • This warranty policy is only valid when products are properly installed and operated in application conditions as specified in the product datasheet.


    • Purchaser receives this ‘standard warranty’ by default. On request, an ‘extended warranty’ or “customized project warranty” can be agreed after evaluation of the specific application conditions.


    • Purchaser shall not rely on any other information or documentation.




    C.  Additional Conditions (non-exhaustive)


    • This warranty is only valid for products sold in Europe. In other regions, other conditions may apply.


    • The Products have been purchased directly from a Eway (sales) organisation.


    • Proof of purchase for the Products is available for inspection by Eway.


    • The Products have been properly installed and operated in accordance with the manufacturer’s instructions.


    • Adequate records of operating history are kept and available for inspection by Eway.


    • A Eway representative will have access to the defective Products. If the Products or other parts become suspect, the representative shall have the right to invite other manufacturers’ representatives to evaluate the lighting systems.


    • Labour costs for (de)-installation of the Products are not covered under this warranty.





    Warranty policy - Terms and Conditions


    1.  Limited Warranty


    This warranty shall only apply to Eway branded lighting products sold by Eway Lighting in the territory of Europe (hereinafter referred to as ‘Product’). The warranty is only applicable to the party purchasing the products directly from Eway (hereinafter referred to as: ‘Purchaser’). The foregoing warranty shall be valid for the period mentioned in the applicable warranty policy for the Products refered to in your sales agreement. If a Product fails to operate in accordance with this warranty Eway will provide a free replacement of the failed.Product subject to the applicable warranty policy and the limited warranty terms and conditions set out below.




    2.  Terms and Conditions


    Eway’ warranty flows only to Purchaser. If any Product covered by this warranty is returned by Purchaser in accordance with section 3 and within the applicable warranty period set out in the warranty policy and on examination Eway determines to its satisfaction that such Product failed to satisfy this warranty, Eway will, at its option, repair or replace the Product or the defective part thereof, or reimburse Purchaser the purchase price. For purposes of clarity, “repair or replace the Product or the defective part thereof” does not include any removal or reinstallation activities, costs or expenses, including without limitation, labor costs or expenses.

    • installation date and invoice date;


    • detailed problem description, number and % of failures date-code of failure;


    • application, hours burned and number of switching cycles; Where a warranty claim is justified, Eway will pay for freight expenses. Eway may charge Customer for returned

    products that are not found to be defective or non-conforming together with the freight, testing and handling costs associated therewith.

    Products supplied by Eway to Customer, whether or not such damages are based on any warranty not explicitly mentioned in these terms and conditions, tort, contract or any

    other legal theory, even if Eway has been advised or is aware of such defects.




    5.  Limitations and conditions

    PART I – GENERAL TERMS



    What Is Covered


    Eway warrants that each Eway product that you purchase is free from defects in materials and workmanship under normal use during the warranty period. The warranty period for a Eway product starts upon the receipt of product or as may be otherwise specified by Eway. The warranty period and types of after-sales service that apply to your product are as specified in “Part II - Types of After-sales Service” below.



    How to Obtain After-sales Service


    If the product does not function as warranted during the warranty period, you may obtain after-sales service by contacting Eway. After-sales service may not be available in all regions and may differ from region to region. Additional charges may apply outside Eway’s normal service areas. Please contact Eway for information specific to your location.



    What Will EWAY Do


    When you contact Eway, you must specify your problem with your product.

    Eway will attempt to diagnose and resolve your problem by telephone, e-mail or live chat. Eway may ask you to take any relevant troubleshooting steps that may fix your issue.

    If the troubleshooting steps provided by Eway cannot fix your issue remotely, you may be required to deliver the product to Eway for further examination. Eway will arrange for service under the type of warranty service designated for the product under “Part II - Types of After-sales Service” below. If the problem with your product is covered by this After-sales Policy, Eway will cover the cost of repair. Otherwise, you may have to apply for Customer Paid Repair Service.



    Product and Part Replacement


    When after-sales service involves the replacement of a product or part, the replaced product or part becomes Eway’s property and the replacement product or part becomes your property. Only unaltered Eway products and parts are eligible for replacement.

    While a product or part replaced by Eway may not be new, it will be in good working order and functionally equivalent to the original product or part. The replacement product or part will be covered under warranty for the remainder of the original product’s warranty.



    Use of Personal Contact Information


    If you obtain service under this policy, you authorize Eway to store, use and process information about your flight logs and your contact information, including your name, phone numbers, address, and e-mail address. Eway may use this information to perform service under this policy. We may contact you to inquire about your satisfaction with our service or notify you of any product recalls or safety issues. Obtaining service under this policy authorizes Eway to transfer your information to any country where we do business and to provide it to entities acting on our behalf. We may also disclose information if required to do so by law.



    What This After-Sales Policy Does NOT Cover


    This policy does not cover the following:


    Crash or fire damage caused by non-manufacturing factors, including but not limited to, pilot errors.


    Damage caused by unauthorized modification, disassembly, or shell opening not in accordance with official instructions or manuals.


    Damage caused by improper installation and incorrect use or operation not in accordance with the official instructions or manuals.


    Damage caused by a non-authorized service provider.


    Damage caused by unauthorized circuit modification and mismatch or misuse of the battery or charger.


    Damage caused by operating the product at a weight greater than the safe takeoff weight as specified by the instruction manuals.


    Damage caused by reliability or compatibility issues when using unauthenticated third-party parts.


    Failure of, or damage caused by, any third party products, including those that Eway may provide or integrate into the Eway product at your request.


    Products or parts with an altered identification label or from which the identification label has been removed.



    Limitation of Liability


    When receiving service, Eway is responsible for loss or damage to your product only while it is in Eway 's possession or in transit, if Eway is responsible for transportation.

    Eway is NOT responsible for loss or disclosure of any data, including confidential information, proprietary information, or personal information, contained in a product.

    Under no circumstances, and notwithstanding the failure of essential purpose of any remedy set forth herein, shall Eway, its affiliates, suppliers, resellers, or service providers be liable for any of the following even if informed of their possibility and regardless of whether the claim is based in contract, warranty, negligence, strict liability or other theory of liability: 1) third party claims against you for damages; 2) loss, damage or disclosure of your data; 3) special, incidental, punitive, indirect or consequential damages, including but not limited to lost profits, business revenue, goodwill or anticipated savings. In no case shall the total liability of Eway, its affiliates, suppliers, resellers, or service providers for damages from any cause exceed the amount of actual direct damages, not to exceed the amount paid for the product.

    The foregoing limitation does not apply to damages for bodily injury (including death), damage to real property or damage to tangible personal property for which Eway is liable under law.

    As some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the above limitation or exclusion may not apply to you.



    Your Other Rights


    This policy provides you with extra and specific legal rights. You may have other rights according to the applicable laws of your state or jurisdiction. You may also have other rights under a written agreement with Eway. Nothing in this policy affects your statutory rights, including rights of consumers under laws or regulations governing the sale of consumer products that cannot be waived or limited by agreement.
